DWI - Legal Limits and Consequences in New York State

For most drivers, the legal limit is a 0.08 percent blood alcohol concentration (BAC). Individuals operating a commercial vehicle can be charged at 0.04 percent, and anyone under the age of 21 is over the legal BAC limit at 0.02 percent.
Penalties for DWIs vary greatly. Courts generally consider factors such as age, license type, and previous infractions when handing out punishments.
